Condition of Use of Culinaris Küchenaccessoires / Cookfunky
§ 1 GENERAL
All purchases, deliveries and other services take place according to these conditions.
§ 2 PRICES
Prices are valid as of the day of ordering. They are in the online bill. All prices include cost of the item, value added tax, plus shipping costs / C.O.D. charges Express Shipping.
Delivery within the EU – Value added tax

§ 3 SHIPPING
By providing your information and clicking the "order now" button you enter into a binding transaction purchasing the items in your shopping cart. You receive a computer-generated e-mail confirming the order. The purchase contract comes into effect through the written confirmation of purchase on the part of the owner of Culinaris® Küchenaccessoires / Cookfunky. Should an item unexpectedly be undeliverable for reasons not having to do with the owner of Culinaris® Küchenaccessoires / Cookfunky, he has the right to withdraw from the transaction.
We are happy to tell you that culinaris.eu can ship to virtually any address in the world and deliver the goods to the delivery address given. Shipping costs for orders from culinaris.eu depend upon the method and option you choose.

§ 4 PAYMENT
Payment per C.O.D. (delivery only within the EU or Austria)
The items (+ C.O.D. charge) have to be paid (brutto) when the postman hands you out your package. The postman receives the money. In additon the postman receives always a 2 Euro C.O.D. fransfer fee.

If you are not the owner of the credit card we may ask for a permisson of the owner that tells you are allowed to use his/her credit card

§ 5 RECLAMATIONS / GUARANTEE
5.1 Reclamations / Guarantee
You agree to advise Culinaris® Küchenaccessoires / Cookfunky immediately of any obvious defect of the goods, including damage during transportation. Please submit notice of damage in written form (email to logistic@culinaris.eu). The guarantee is 2 years (see § 438 Abs. 1 Nr. 3 BGB). Valid complaints of obvious defects, or of other defects within two years of delivery, entitle the customer to repair or replacement of the goods free of charge, according to the wishes of the customer.
If you receive the order and the package is damaged, you must fill out a damage protocol that requires your signature as well as the postman’s signature.
If the sending back of goods to Culinaris Küchenaccessoires® / Cookfunky is not prepaid it will be not accepted (see § 312 Abs. 3 Satz 2 BGB).
5.2 Right of return / of withdrawal
You have the right to take advance of the right of return / of withdrawal of the products you ordered within a two-week period from the day on you received the ordered products (see § 312 Abs. 1 Satz 1, i.V. m. § 355 Abs. 1 Satz 2, § 356 Abs. 2 Satz 2, § 357 Abs. 3 BGB). § 6 OWNERSHIP
The shipped items are property of Culinaris® Küchenaccessoires / Cookfunky until they are fully paid.
§ 7 LEGAL INFORMATION
The legal domicile is for all lawsuits concerning the contract Leipzig. The German law is valid for all lawsuits between Culinaris® Küchenaccessoires / Cookfunky and the contract partner, also for foreign customers. Contractual language is German.
§ 8 Participation in the online dispute resolution program
The Online Dispute Resolution website is an official website managed by the European Commission dedicated to helping consumers and traders resolve their disputes out-of-court. We are obliged to participate in this program. You can find the Online Dispute Resolution website here.

§ 9 Purchase on account and financing with Klarna (only available in Germany)
In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment methods. Payment is to be made to Klarna.
- Pay in [14] days: The payment period is 14 days from shipment of the goods or tickets/ availability date of the service. You can find the complete terms and conditions for the markets where this payment method is available here: Germany.
- Financing: With the financing service from Klarna you can pay your purchase in flexible or fixed monthly instalments according to the conditions stated in the checkout. The instalment payment is due at the end of each month after submission of a separate monthly invoice by Klarna. - Direct bank transfer: Available in Germany. Your account will be debited directly after placement of your order.
- Direct Debit: Your account will be debited after shipment of the goods or tickets/ availability date of the service or in case of a subscription in accordance with the timelines communicated. You will be notified about the date(s) by email.
- Card Payments: Available in Germany. The amount will be reserved on your card and will be debited after shipment of the goods or tickets/ availability date of the service. In case of a subscription the amount will be debited in accordance with the timelines communicated.
The payment methods Pay in [14] days, Slice It and direct debit are only available in case of a positive credit assessment. For this purpose, during the order process and handling of your purchase, we forward your data for an address and credit check to Klarna.
